Austin, TX (Law Firm Newswire) April 16, 2012 – The woman in this drunk driving debacle killed a man while she was under the influence of several substances.

“You’d think people would get the point that you don’t drink and drive, as it is a recipe for an accident, and that is what happened here,” explained Robert W. The man was taken to the hospital, and doctors thought he had a chance to pull through after his emergency surgery. He died a few days later, with the autopsy showing he died from a pulmonary embolism – a blockage in the main artery of the lung.

The woman was pregnant at the time of the accident, and her blood alcohol content was .251. Her tests also showed she had opiates and anti-anxiety medications onboard at the time of the accident. “What is so startling about this case is that here is this woman, loaded on medications mixed with booze, and she is driving. What on earth would make her think that was a wise thing to do?” asked Lee.

The upshot of this accident is the woman faces a three-year prison term for homicide by motor vehicle, and that is the minimum term she could possibly get from the courts. This was not the only thing she was charged with though. She was cited for DUI, accidents causing death and four counts of driving under the influence. “In short, the police mostly threw the book at her,” Lee commented.

As a result of this horrendous situation, the courts ordered the woman not to have any contact with the victim’s family; a restriction that barred her from apologizing. Her attorney apologized for her, and while the expression of sympathy was likely well meaning, the man is dead and his family in shock.

“Basically, but for the negligence of the woman in this case, the man who died would still be alive today. The woman has been in drug and alcohol treatment programs and attending counseling sessions. Again, all well and good, but with her existing priors, including a charge for assault, no one is sure whether or not this will happen again, and if another innocent person will lose their lives,” added Lee.
