
Father of Eighth Grader Sues Loyola over Slip and Fall Accident on Campus

Chicago, IL (Law Firm Newswire) April 23, 2019 – A Chicago Public Schools (CPS) student’s father filed a premises liability lawsuit against Loyola University Chicago after the eighth grader sustained injuries during a retreat in October 2017. The accident occurred on Loyola’s Retreat and Ecology Campus (LUREC) in Woodstock, Illinois.
The student slipped and fell, hitting his head on a gate’s fork latch. The gate was located at the entrance of a basketball court. The injured student was taken to an area hospital where he received treatment for his wound. His family incurred medical expenses totaling almost $4,000.

The eighth-grade student was participating in a retreat at LUREC through Chicago’s Ole A. Thorp Elementary Scholastic Academy. The lawsuit accused Loyola of being “careless and negligent” in the management of the campus. The university allegedly ignored the gate’s potential danger, failed to warn people about its risks, and did not replace it with an automatic gate to prevent injuries.
Loyola claimed the student was at least partially to blame for his injuries as the incident occurred under CPS supervision. The university said the student should have taken responsibility for his own safety by ensuring the gate was shut. Loyola denied responsibility for installing an automatic gate and accused the CPS school of being negligent in supervising its students.
The lawsuit is seeking $50,000 in damages for the student’s injuries and losses, in addition to attorney’s fees and other court costs. The slip and fall accident left the student with visible scarring on his head and forehead.
